Chit funds, BC and kitty committees: what's safe and what's illegal

Short answer: Registered chit funds are a legal, regulated way to save and borrow. Every chit must be approved (sanctioned) and registered by the state government. Schemes that promise guaranteed returns, or pay you for bringing in new members, are illegal. Informal BCs and kitty committees among friends rely only on trust. If the organiser disappears, there’s usually no regulator to help. A chit works like a loan for people who win early and like a savings plan for those who win late.
How a chit works
A group pays a fixed amount every month, and each month one member gets the pot. Members who want it early bid a discount, which means they offer to take less than the full pot. The organiser (called the “foreman”) takes a commission. The rest of the discount is shared among everyone as a “dividend”, and this lowers that month’s payment.

A ₹1,00,000 chit: 20 members pay ₹5,000 a month for 20 months. The foreman’s commission is 5% (₹5,000) each month.
Month 2: the winning bid is a ₹30,000 discount.
- Dividend: (₹30,000 − ₹5,000) ÷ 20 = ₹1,250 each, so everyone pays ₹3,750 that month.
- The winner, Anil, receives ₹1,00,000 − ₹30,000 = ₹70,000.
Suppose month 1 has no auction. After that, the winning discount falls evenly from ₹30,000 (month 2) to ₹5,000 (month 20). Over the 20 months each member pays ₹88,125 in total.

Know which one you are. If you win early, you are in practice borrowing at a high cost.
The law in brief
- Chit Funds Act, 1982: no chit can be started without the state government’s approval in advance (prior sanction) and registration.
- Prize Chits and Money Circulation Schemes (Banning) Act, 1978: bans prize chits and chain schemes, where your money depends on signing up more people.
- Banning of Unregulated Deposit Schemes (BUDS) Act, 2019: bans deposit schemes that are not run under any regulator, with heavy penalties. Registered chits are outside this ban.

If a scheme falls apart
- Collect every receipt, agreement and message.
- File a police complaint. Others who lost money may join you.
- Under the BUDS Act, states have authorities that can attach (legally take hold of) the property of illegal deposit schemes. Ask the police or your state’s finance department.

Myths
- “All chit funds are scams.” Registered chits are a legal product.
- “A chit gives fixed returns.” Your result depends on when you win and on the discounts.
- “Our BC is among friends, so it’s safe.” Trust isn’t legal protection.
- “Bringing in new members is just helping.” If you earn money for recruiting people, it’s a banned chain scheme.
